The State Revenue Committee of the Ministry of Finance of the Republic of Kazakhstan informs individuals traveling across the customs border of the Eurasian Economic Union about the current procedure for importing goods for personal use and the criteria by which such goods are classified as goods for personal use.
The legal basis for regulation is the Customs Code of the Eurasian Economic Union, the Decision of the Council of the Eurasian Economic Commission dated December 20, 2017 No. 107 "On certain issues related to goods for personal use" and the Order of the Minister of Finance of the Republic of Kazakhstan dated March 31, 2015 No. 250 "On the establishment of criteria for the classification of goods transported by individuals across the customs border Of the Customs Union, to goods for personal use."
Goods for personal use are goods intended to meet the personal, family, and household needs of an individual that are not related to entrepreneurial activity.
The movement of goods for personal use across the customs border of the Eurasian Economic Union (Eurasian Economic Union) is regulated by Chapter 37 of the Customs Code of the Union.
By Order of the Minister of Finance of the Republic of Kazakhstan dated March 31
2015 No. 250 established quantitative and qualitative criteria for classifying goods transported by individuals in accompanied and unaccompanied baggage as goods for personal use.
Quantity indicators per person are set, in particular, for the following products:
- fur products – 1 (one) item of the same name, size and style per person;
- mobile phone – 2 (two) units per person;
- tablet – 2 (two) units per person;
- portable computer and its accessories (laptop, netbook) – 1 (one) unit per person;
- jewelry – 5 (five) items per person;
- bicycle – 1 (one) piece per person;
- baby carriage – 1 (one) piece per person;
A prerequisite is the frequency of movement: goods are classified as goods for personal use when an individual crosses and/or moves goods across the customs border no more than once a month.
Quantity indicators do not apply to used goods, with the exception of vehicles for personal use. Vehicles for personal use imported in any way in the amount of more than 1 unit per year are considered as intended for entrepreneurial activity.
Cost, weight and quantity standards of duty-free import
Decision No. 107 of the Council of the Eurasian Economic Commission dated December 20, 2017 established the cost, weight and (or) quantitative norms within which goods for personal use are imported into the customs territory of the Eurasian Economic Union without payment of customs duties and taxes (Appendix No. 1 to the Decision). The uniform rates of customs duties and taxes, as well as the categories of goods for which the total customs payment is payable, are determined by Appendix No. 2 to the Decision.
The cases and conditions for the import of goods for personal use with exemption from customs duties and taxes are defined in Appendix No. 3 to the Decision;
The list of used goods imported by foreign individuals for the period of stay without payment of customs duties and taxes, regardless of cost and weight, is provided in Appendix No. 4.;
Categories of goods that are not related to goods for personal use are provided in Appendix No. 6 to the Decision.
Within the framework of Appendix No. 3 to the Decision, issues related to the import of goods for personal use by certain categories of persons are regulated, in particular. Thus, certain categories of employees of foreign institutions and family members living with them have the right to import goods for personal use (with the exception of vehicles for personal use and the bodies of such vehicles) with exemption from customs duties and taxes, regardless of cost and weight — independently or through another person acting on their behalf and on behalf of, subject to the established conditions, including the frequency of importation no more than 1 time per calendar year within the period of work in a foreign institution.
For reference: the fact that a natural person imported a product does not in itself confirm its personal nature, the product is evaluated taking into account its nature, quantity, frequency of movement and other circumstances.
If the established norms are exceeded or the periodicity criterion is violated, the goods may be classified as goods not intended for personal use, in which case the general procedure for customs declaration and payment of customs duties applies.
The declaration of goods for personal use subject to customs declaration is carried out using a passenger customs declaration.
