User Agreement

    This User Agreement governs the use of the memleket.kz online resource, including its pages, services, and functionality.

    By using the Website, viewing its materials, registering an account, subscribing to notifications, or submitting information through the Website’s forms, the User confirms that they have read, understood, and accepted the terms of this Agreement.

    If the User does not agree with the terms of this Agreement, they must stop using the Website.

    1. Definitions

    The following terms are used in this Agreement:

    Website means the memleket.kz online resource, including its language versions, pages, sections, software components, and related services.

    Administration means the Website Owner and persons responsible for the management, technical maintenance, and development of the Website.

    Website Owner means Individual Entrepreneur Mustafin K. B., Individual Identification Number 950505350297.

    User means any individual or legal entity using the Website.

    Account means a set of User data used to access certain functions of the Website.

    Materials means texts, news, documents, information about government authorities, organizations and individuals, images, graphics, databases, links, and other information published on the Website.

    User Materials means information, messages, requests, comments, questions, and other materials submitted by the User through the Website’s functions.

    2. Status and Purpose of the Website

    2.1. memleket.kz is an independent information portal that collects, organizes, and provides Users with access to information obtained from publicly available sources.

    2.2. memleket.kz:

    • is not an official online resource of the government authorities of the Republic of Kazakhstan;

    • does not represent government authorities or organizations;

    • does not provide public services;

    • is not authorized to provide official interpretations of regulatory legal acts;

    • does not replace official sources, government information systems, or professional advice.

    2.3. The Website Materials are provided solely for informational and reference purposes.

    2.4. To perform legally significant actions, make decisions, or verify whether information is current, the User must refer to the original source, the official online resource of the relevant government authority, or a qualified professional.

    2.5. In the event of any discrepancy between information published on memleket.kz and information published by an official source, the information from the official source shall prevail.

    2.6. Publication of information about a government authority, organization, public official, or any other person does not indicate the existence of any partnership, contractual relationship, endorsement, or official relationship between that person or entity and the Website Owner.

    3. Use of the Website

    3.1. The User may use the Website for personal, informational, educational, research, and other lawful purposes.

    3.2. Access to the main part of the Website Materials is provided free of charge unless otherwise expressly stated on the relevant page.

    3.3. Certain functions of the Website may only be available after registration, email address verification, or completion of other actions required by the Website.

    3.4. The Administration may:

    • change the structure, design, and functionality of the Website;

    • add, modify, or remove sections and Materials;

    • correct errors and inaccuracies;

    • temporarily restrict access to the Website for technical maintenance;

    • introduce new rules for the use of certain functions;

    • discontinue certain services or functions.

    3.5. The Administration does not guarantee that all functions of the Website will be continuously available, uninterrupted, or free from technical errors.

    3.6. The Website Materials may not be used in a manner that creates a false impression that the User acts on behalf of memleket.kz or has an official relationship with the Website Owner.

    4. Registration and Account

    4.1. When registering, the User must provide accurate and up-to-date information.

    4.2. The User is solely responsible for:

    • maintaining the confidentiality of their login credentials;

    • all actions performed through their Account;

    • using a secure password;

    • promptly notifying the Administration of unauthorized access to the Account.

    4.3. The User may not transfer access to their Account to third parties, use another person’s Account without permission, or register on behalf of another person.

    4.4. The Administration may restrict or terminate access to an Account if the User:

    • violates this Agreement;

    • provides false or inaccurate information;

    • uses the Website for unlawful activities;

    • creates a security risk for the Website or other Users;

    • uses automated tools that place an excessive load on the Website’s infrastructure;

    • performs actions that may cause damage to the Website, the Administration, or third parties.

    4.5. The User may request the deletion of their Account using the contact details specified in Section 15 of this Agreement.

    4.6. Deletion of an Account does not automatically result in the deletion of information that the Administration is required to retain under applicable law or information obtained from publicly available sources independently of the User’s registration.

    5. User Obligations

    When using the Website, the User must:

    • comply with the laws of the Republic of Kazakhstan;

    • respect the rights and legitimate interests of other persons;

    • not interfere with the operation of the Website or its software infrastructure;

    • not distribute malicious software;

    • not attempt to gain unauthorized access to Accounts, servers, databases, or restricted sections;

    • not impersonate another person, a representative of a government authority, or a representative of the Administration;

    • not use the Website for fraud, spam distribution, or dissemination of prohibited information;

    • not submit Materials that infringe copyright, image rights, privacy rights, personal data rights, or other rights of third parties;

    • not perform large-scale automated data collection in circumvention of applicable restrictions;

    • not use the Website Materials in a manner that may damage the business reputation of memleket.kz or third parties;

    • not use information published on the Website for harassment, threats, discrimination, or other unlawful activities.

    Standard search engine crawlers may access the Website subject to compliance with the rules published in the robots.txt file and provided that they do not create an excessive load on the Website.

    6. User Materials and Requests

    6.1. The User is responsible for the content of information submitted through feedback forms, questions, comments, and other Website functions.

    6.2. The User represents and warrants that the submitted Materials:

    • are accurate or represent the User’s personal opinion;

    • do not violate applicable law;

    • do not infringe the rights of third parties;

    • do not contain malicious code, spam, or unlawful advertising;

    • do not contain personal data of third parties without a lawful basis;

    • do not contain insults, threats, incitement to violence, or other prohibited information.

    6.3. By submitting Materials for publication on the Website, the User grants the Administration a royalty-free, non-exclusive right to store, reproduce, edit, translate, publish, and display such Materials to the extent necessary for the operation of the relevant service.

    6.4. The User retains the rights to the Materials created by them.

    6.5. The Administration may moderate, hide, edit, or remove User Materials without prior notice if they violate this Agreement, applicable law, or the rights of third parties.

    6.6. Submission of a request through the Website does not guarantee that a response will be provided or that the request will be published.

    6.7. The Administration may request additional information, documents, or evidence required to review a request.

    7. Sources and Accuracy of Information

    7.1. The Website may publish information obtained from:

    • official online resources of government authorities;

    • publicly accessible government information systems;

    • regulatory legal acts;

    • public registers and databases;

    • official statements and press releases;

    • responses from government authorities and organizations;

    • mass media;

    • other publicly available sources.

    7.2. The Administration makes reasonable efforts to keep information up to date but does not guarantee the absolute completeness, accuracy, or timeliness of all Materials.

    7.3. Information in the original source may be amended, supplemented, or removed after its publication on memleket.kz.

    7.4. The Website may contain:

    • technical errors;

    • delays in updating information;

    • inaccuracies in source data;

    • differences between language versions;

    • unavailable or modified external links;

    • errors arising from automated processing, translation, or organization of information.

    7.5. The User must independently verify important information using the original source.

    7.6. Information about individuals, public officials, executives of organizations, and other persons may be published on the basis of information available in official or other publicly accessible sources.

    7.7. Any person who identifies inaccurate, outdated, or misleading information may submit a request to the Administration.

    7.8. A request should include:

    • a link to the relevant Website page;

    • a description of the disputed information;

    • the correction requested;

    • links to current official sources;

    • supporting documents or other evidence, where necessary.

    7.9. After reviewing the request, the Administration may correct, supplement, hide, or remove the relevant Material.

    7.10. The submission of a request does not automatically mean that the published information is unlawful, inaccurate, or infringes the applicant’s rights.

    8. Intellectual Property

    8.1. Exclusive rights to the software code, structure, design, logo, interface elements, original texts, and other Materials created for memleket.kz belong to the Administration or the respective rightsholders.

    8.2. Rights to Materials obtained from third-party sources belong to their respective authors and rightsholders.

    8.3. Publication of third-party Materials or links to such Materials on memleket.kz does not transfer exclusive rights to the Administration.

    8.4. Quotation of Website Materials is permitted to the extent justified by informational, scientific, educational, or other lawful purposes, provided that memleket.kz is identified as the source and an active link to the relevant Material is included.

    8.5. Without the prior written permission of the Administration, it is prohibited to:

    • copy substantial parts of the Website or its databases;

    • systematically reproduce Website Materials;

    • create copies or mirror versions of the Website;

    • resell or provide paid access to copied databases;

    • remove authorship, source, or rightsholder notices;

    • use the Website’s design, logo, or branding in a manner that creates a false impression of an official relationship with memleket.kz;

    • use automated tools for large-scale extraction and republication of Materials.

    8.6. A rightsholder who identifies a suspected infringement may submit a request to the Administration containing:

    • a link to the disputed page;

    • a description of the copyright or other protected object;

    • information about the rightsholder;

    • documents or other evidence confirming the relevant rights;

    • the applicant’s requested action.

    8.7. The Administration may temporarily restrict access to disputed Material while the request is being reviewed.

    9. Personal Data and Privacy

    9.1. Users’ personal data is processed in accordance with the laws of the Republic of Kazakhstan and the memleket.kz Privacy Policy.

    9.2. Depending on the functions used, the Website may process:

    • the User’s name;

    • email address;

    • telephone number, if provided by the User;

    • Account data;

    • IP address;

    • browser and device information;

    • cookies;

    • history of interaction with the Website;

    • information voluntarily submitted through Website forms.

    9.3. Personal data may be processed for the following purposes:

    • registration and operation of the Account;

    • provision of Website functions;

    • delivery of subscriptions and notifications requested by the User;

    • processing of requests;

    • ensuring security;

    • preventing misuse;

    10.3. The User may unsubscribe:

    • by using the unsubscribe link contained in a message;

    • by submitting a request to the Administration.

    10.4. Service messages relating to security, access recovery, amendments to applicable terms, or Account operation may be sent regardless of whether the User has subscribed to informational Materials.

    10.5. The Administration does not guarantee delivery of notifications where delivery is prevented by the actions or systems of a telecommunications provider, email service, third-party platform, or the User’s settings.

    11. External Links, Services, and Advertising

    11.1. The Website may contain links to third-party online resources, embedded services, advertisements, and partner Materials.

    11.2. The Administration does not control the content, availability, security, or data-processing practices of third-party resources.

    11.3. The User follows external links at their own discretion and risk.

    11.4. Publication of an advertisement or link to a third-party resource does not mean that the Administration guarantees the quality, safety, or suitability of the advertised goods, services, or organizations.

    11.5. Relations between the User and an advertiser, seller, or third-party service provider are governed directly between the relevant parties.

    11.6. Advertising, partnership, and sponsored Materials may be accompanied by an appropriate disclosure.

    11.7. The advertiser is solely responsible for the content, accuracy, and lawfulness of the advertising it provides.

    12. Limitation of Liability

    12.1. The Website and its Materials are provided on an “as is” basis to the extent permitted by the laws of the Republic of Kazakhstan.

    12.2. The Administration does not guarantee:

    • the absolute accuracy or completeness of the Materials;

    • the suitability of information for the User’s individual purposes;

    • continuous availability of the Website;

    • the absence of technical errors;

    • the preservation of information on third-party resources;

    • the legal validity of published copies of documents;

    • the absence of errors in automated translation or data processing.

    12.3. The Administration is not liable for decisions or actions taken by the User solely on the basis of Website Materials without verification through official sources.

    12.4. The Administration is not liable for losses resulting from:

    • temporary unavailability of the Website;

    • technical failures;

    • acts or omissions of third parties;

    • use of external links;

    • unauthorized access to an Account caused by the User;

    • errors or outdated information in original sources;

    • amendment or removal of information by an official source;

    • use of information by the User in violation of applicable law or third-party rights.

    12.5. The Administration is not responsible for User Materials before receiving reliable information about a potential violation and conducting the necessary review.

    12.6. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under the laws of the Republic of Kazakhstan.

    13. Restriction and Termination of Access

    13.1. The Administration may temporarily restrict or terminate the User’s access to certain functions or the entire Website without prior notice if the User violates this Agreement.

    13.2. Access restrictions may be imposed for the following purposes:

    • protecting the Website and its Users;

    • preventing technical attacks;

    • stopping unlawful activities;

    • complying with legal requirements and lawful requests from authorized government authorities;

    • conducting technical maintenance;

    • preventing large-scale automated data collection;

    • protecting the rights and legitimate interests of the Administration and third parties.

    13.3. The User may request a review of the restriction using the Administration’s contact details.

    13.4. The Administration may limit the number of requests, submissions, and other User actions to protect the Website from excessive load and misuse.

    14. Amendments and Dispute Resolution

    14.1. The Administration may amend this Agreement.

    14.2. A new version becomes effective upon publication on the Website unless another effective date is specified in the new version.

    14.3. The date of the latest update is indicated at the beginning of this document.

    14.4. Continued use of the Website after amendments are published constitutes acceptance of the revised Agreement.

    14.5. This Agreement is governed by the laws of the Republic of Kazakhstan.

    14.6. The parties are encouraged to first attempt to resolve disputes by submitting a written request to the Administration.

    14.7. The timeframe for reviewing a request is determined by the laws of the Republic of Kazakhstan and the nature of the request.

    14.8. If a dispute cannot be resolved through negotiations, it shall be resolved in accordance with the procedure established by the laws of the Republic of Kazakhstan.

    14.9. If any provision of this Agreement is found to be invalid, the remaining provisions shall remain valid and enforceable.

    14.10. This Agreement does not restrict any mandatory rights of Users or consumers provided by the laws of the Republic of Kazakhstan.
