    What should I do if Your right to access information is illegally restricted?

    In accordance with article 18 Of the law of the Republic of Kazakhstan «On access to information», an illegal restriction of the right to access information can be appealed to a higher state body (a higher official) or to a court.

    Article 456-1 Of the code of the Republic of Kazakhstan «On administrative offences» provides for administrative liability for illegal restriction of the right to access information in the form of fines from 20 to 200 monthly calculation indices (MCI), depending on the type of violation.

    In addition, civil servants, in accordance with the Law of the Republic of Kazakhstan «On public service», are subject to disciplinary liability for failure to perform or improper performance of their official duties, including the requirements of legislation on access to information.
