Amendments to the Tax Code of the Republic of Kazakhstan entered into force at the beginning of 2026, aimed at enhancing tax administration efficiency and fostering greater transparency in interactions between taxpayers and the state revenue authorities. Cameral audits remain a cornerstone of tax control, enabling authorities to identify variances between declared tax reporting data and a taxpayer's actual operational activities.
A modernized format for notifications of discrepancies has been approved, which is designed to facilitate rapid compliance, allowing taxpayers to rectify identified variances or submit formal explanations.
Article 137 of the 2026 of the TC RK establishes the legal framework and statutory procedures for conducting cameral audits. It is executed following the submission of tax returns, remain enforceable throughout the statutory limitation period, and specifically designed to cross-reference taxpayer data against the information maintained by the tax authorities.
Upon receipt of the notification, the taxpayer has the right either to eliminate violations or to provide reasonable explanations confirming the absence of the law violations. The deadline for notification execution is 30 working days from the date of delivery. The document is sent to all taxpayers, except for participants in horizontal monitoring, and is also distributed to foreign companies operating through online platforms in Kazakhstan.
Notification execution is possible in several ways:
if agreed, submit an additional tax reporting form, pay arrears and penalties, reflect the data in mobile applications (for the self—employed), or perform actions to switch to the appropriate tax regime;
in case of disagreement, provide written explanations with supporting documents;
with partial agreement, eliminate some of the discrepancies and provide explanations for the rest ones.
The introduction of a new notification form makes the desk control process more transparent and allows taxpayers to flexibly respond to identified discrepancies. The key condition for compliance with the law remains the timely execution of the notification and the correct reflection of data using digital tools.
Failure to execute a notification within the prescribed statutory period entails mandatory administrative enforcement measures by the state revenue authorities. including the suspension of debit operations on bank accounts, the block on electronic invoice issuance, and the restriction of access to internet resources for foreign companies conducting business via online platforms.
