1. General provisions
1. This job description has been developed in accordance with the Law of the Republic of Kazakhstan "On the Civil Service of the Republic of Kazakhstan", Standard qualification requirements for categories of administrative government positions of the "B" building in order to determine the subordination, duties, rights, responsibilities of the head of the state institution "Management of Construction of the West Kazakhstan region" (hereinafter-Management).
2. The Head of the department (hereinafter referred to as the Head) is guided in his work by the Constitution of the Republic of Kazakhstan, the constitutional laws of the Republic of Kazakhstan "On the President of the Republic of Kazakhstan",
"On the Government of the Republic of Kazakhstan", the laws of the Republic of Kazakhstan
"On the Civil Service of the Republic of Kazakhstan", "On Combating Corruption", "On Legal Acts", "On Public Services" and the Administrative Procedural Procedure Code of the Republic of Kazakhstan, the Ethical Code of Civil Servants of the Republic of Kazakhstan (Rules of Official Ethics of Civil Servants), approved by Decree of the President of the Republic of Kazakhstan dated December 29, 2015 No. 153, regulatory legal acts of the Republic of Kazakhstan regulating relations in the field corresponding to the specialization of the position in this category, and this job description.
3. The head is appointed and dismissed by the order of the Akim of the West Kazakhstan region in accordance with the current legislation.
4. The head obeys and receives orders, work orders from the akim of the region, the supervising deputy akim of the region, deputy akims of the region in the supervised areas of activity.
5. All civil servants and technical staff of the Department are directly subordinate to the Head.
6. Issues related to the performance of the official duties of the Head of the Department in the event of the temporary absence of the main employee (vacation, business trip) are assigned, if there is a management staff, to the deputy head of the department or the head of the management department, as determined by the head of the department.
2. The rights of the Manager
1. Makes decisions within the scope of the tasks and functions assigned to it.
2. In accordance with the procedure established by law, requests and receives from government agencies, organizations, individuals and legal entities documents and information necessary to perform their functions, as well as provides information to other government agencies.
3. Considers, within the limits of its competence, issues received from legal entities and individuals.
4. In accordance with the procedure established by legislation and other regulatory acts, requests and receives from state and non-state structures the necessary documents and materials on issues within its competence.
5. Participates in the development of decisions on issues related to financial, credit, investment, tax policy and in other cases affecting the implementation of construction policy in the region.
6. Submits proposals to local executive bodies aimed at protecting citizens' rights to a favorable habitat and life activity within the territory of the settlement in accordance with the state construction policy.
7. Monitors the progress and quality of the work performed by the contractor (general contractor) and compliance with the deadlines for their completion.
8. Does not accept works performed in violation of the requirements from the contractor.
9. Controls the activities of technical supervision.
10. Refuses to receive technical and copyright supervision opinions in case of inconsistencies.
11. Engages engineering organizations for project management for the construction of technically complex facilities, including unique construction facilities and large investment projects, by the customer (investor) of the project (program).
12. Organizes and directs the work of the Department and is personally responsible for the fulfillment of the tasks assigned to the Department and the performance of its functions.
13. Determines the duties and powers of his deputies, heads of departments and employees of the Department.
14. In accordance with the current legislation, appoints and dismisses employees of the Department.
15. In accordance with the procedure established by law, resolves issues of encouragement, provision of financial assistance, and imposition of disciplinary penalties on employees of the Department.
16. Approves regulations on departments and job descriptions of Management employees.
17. Within the limits of his competence, issues orders, gives instructions, makes decisions on other matters within his competence, and signs official documents.
18. Represents Management in government agencies and other organizations.
19. Resolves issues of financial, economic and business activities in accordance with the established procedure, monitors the rational and targeted execution of budget funds.
20. The course of execution of regulatory legal acts, draft programs and other documents on issues within the competence of the department is monitored.
21. On the implementation of public procurement.
22. Exercises other rights and powers stipulated by the legislation of the Republic of Kazakhstan and the Regulations on Management.
3. Responsibilities of the Manager
1. Management, organization and planning of the work of the Department to ensure the fulfillment of the tasks and functions facing the Department.
2. Management and organization of the complex of Management activities for the performance of functions:
1) implementation of the state policy in the field of architecture, urban planning and construction in the territory of the West Kazakhstan region;
2) implementation of housing construction programs in the West Kazakhstan region;
3) participation in protecting the rights of consumers of construction products, ensuring the reliability and safety of construction and operation of facilities;
4) coordination, within its competence, of the activities of other government agencies and construction organizations for the implementation of investment programs in the field of construction;
5) transfer to the contractor (general contractor) of the approved design (design and estimate) documentation prior to the start of construction and installation work;
6) providing the facility with all necessary permits provided for by the legislation of the Republic of Kazakhstan;
7) ensuring the construction of the facility with the support of technical and copyright supervision;
8) taking measures against the contractor (general contractor) for non-fulfillment or untimely and poor-quality execution of instructions from technical and copyright supervision;
9) provision of working conditions for technical and copyright supervision;
10) ensuring compliance with the regulations of the state architectural and construction control and supervision bodies;
11) ensuring access to the facility of officials of the state architectural and construction control and supervision bodies for monitoring the activities of technical supervision;
12) within three working days from the date of approval of the act of acceptance of the facility into operation, sending to the state architectural and construction control and supervision authorities at the location of the facility the approved act of acceptance of the facility into operation, the declaration of conformity and the conclusion on the quality of construction and installation work performed and their compliance with the approved project;
13) coordination of activities for the implementation of a comprehensive urban planning scheme for territories (draft district planning of an area or part of it), approved in accordance with the established procedure, master plans of settlements in the territory of the region;
14) submitting for consideration by the regional maslikhat approval of the draft general plan of a city of regional significance with an estimated population of over one hundred thousand inhabitants for subsequent submission to the Government of the Republic of Kazakhstan;
15) organization of the development and submission to the Government of the Republic of Kazakhstan for approval of master plans of cities of regional significance with an estimated population of over one hundred thousand inhabitants, approved by the regional maslikhat;
16) submission to the regional maslikhat for approval of comprehensive urban planning schemes for the territory of subordinate administrative-territorial units (district planning projects), as well as draft general plans for the development of cities of regional significance with an estimated population of up to one hundred thousand inhabitants, approved by the city maslikhats;
17) submitting proposals to the regional maslikhat, conditioned by city-forming factors, on establishing or changing the boundaries of subordinate administrative-territorial units in accordance with the legislation of the Republic of Kazakhstan;
18) coordination of draft general plans of cities of regional importance;
19) informing the public about the planned development of the territory or other urban planning changes;
20) organization of the development, approval and implementation of urban planning projects (detailed planning projects, building projects) developed for the development of approved master plans (integrated urban planning scheme, planning projects) of settlements;
21) assistance in the work of state bodies of architectural and construction control and supervision in the territory of the region;
22) provision of information and (or) information for entry into the database of the state urban planning cadastre in accordance with the established procedure;
23) organization of a comprehensive urban planning examination of draft general plans of cities of regional significance with an estimated population of up to one hundred thousand inhabitants;
