Regarding the restoration of the status of the terminated public procurement contract on the public procurement web portal, we explain that according to paragraph 21 of Article 3 of the Law of the Republic of Kazakhstan "On Public Procurement," a public procurement contract is a civil contract concluded through a web portal between the customer and the supplier, certified by the EDS, except for cases provided for by the rules for public procurement approved by the authorized body.
According to paragraph 1 of Article 401 of the Civil Code of the Republic of Kazakhstan (hereinafter referred to as the Code), amendment and termination of the contract is possible by agreement of the parties, unless otherwise provided by the Code, other legislative acts and the contract.
At the same time, in accordance with paragraph 1 of Article 403 of the Code, upon termination of the contract, the obligations of the parties terminate.
In this regard, given that the obligations of the parties terminate due to the termination of the contract, it is not possible to restore the contract on the public procurement web portal.
