    What payments is a microfinance organization (MFO) entitled to withhold on a microloan?

    Answer

    In accordance with Article 1 of the Law “On Microfinance Activities,” a microloan is money provided by a microfinance organization to a borrower in the national currency of the Republic of Kazakhstan, in an amount and manner determined by this Law, on the terms of paid service, fixed term, and repayment.

    According to paragraph 3 of Article 7 of the Law “On Microfinance Activities,” a microfinance organization is not entitled to establish or collect from the borrower (applicant) any payments under a microloan, except for remuneration and penalties (fines, late fees).
