    Are there any restrictions on charging penalties (fines/late fees) on problematic loans/microloans?

    Answer

    According to Article 34 of the Law “On Banks and Banking Activities in the Republic of Kazakhstan” and Article 7 of the Law “On Microfinance Activities,” under a loan/microloan agreement with an individual borrower who is not engaged in entrepreneurial activity, the bank/MFO is prohibited from demanding payment of fees or penalties (fines, late charges) accrued after ninety consecutive calendar days of delay in fulfilling any payment obligations related to the principal amount and/or fees.
    In the case of a mortgage loan agreement with an individual, such fees or penalties cannot be demanded after one hundred eighty consecutive calendar days of delay.
