    Is it possible to receive compensation from a bank in the process of forced liquidation out of turn?

    Answer

    The procedure for settlements with creditors is established by Article 74-2 of the Law of the Republic of Kazakhstan “On Banks and Banking Activities in the Republic of Kazakhstan.”

    According to paragraph 4 of Article 74-2 of the Law, the claims of each priority rank shall be satisfied only after full satisfaction of the claims of the preceding priority rank.

    In other words, if the liquidation commission is making settlements with second-priority creditors, settlements with third-priority creditors shall commence only after the claims of the second-priority creditors have been fully satisfied.

    No alternative procedure for settlements with creditors of a liquidated bank is provided for by the legislation.
