    Is a debt collection agency required to pay mandatory contributions to the offices of the Banking and Microfinance Ombudsman?

    Answer

    According to paragraph 5 of Article 3 of the Law of the Republic of Kazakhstan "On Collection Activities," a collection agency is obliged to pay mandatory fees to the Banking Ombudsman’s office upon acquiring rights (claims) under a bank loan agreement concluded between a bank or an organization performing certain types of banking operations and an individual. Additionally, the collection agency must pay mandatory fees to the Microfinance Ombudsman’s office upon acquiring rights (claims) under a microloan agreement concluded between a microfinance organization and an individual.
