    What actions are recommended if a bank loan has been fraudulently arranged via social engineering?

    Answer

    The applicant must:
    - Contact the contact center of the financial organization where the loan was issued, submit a fraud report requesting the blocking of accounts, mobile applications (if necessary), and the initiation of an internal investigation;
    - Apply to law enforcement authorities to register the fraud case and initiate a criminal proceeding, recognizing the applicant as a victim, attaching all available data and information.
    In accordance with paragraph 15 of Article 34 of the Law on Banks (effective from August 20, 2024), the bank or organization performing certain banking operations, no later than three calendar days from the receipt of a submission from law enforcement authorities regarding measures to eliminate circumstances that contributed to the commission of a criminal offense, or from the issuance of a ruling recognizing the borrower - an individual - as a victim, is obliged to suspend debt collection and claim enforcement activities related to the client’s bank loan, as well as the accrual of fees and/or penalties.
