In accordance with Articles 23 and 24 of the Law on Joint-Stock Companies, if the company or the system of securities holders’ registries, or the nominee holding accounting system lacks up-to-date shareholder details, the payment of dividends on both common and preferred shares must be made in the manner and within the timeframes established by the regulatory legal act of the authorized body, to an account opened at the central depository for the purpose of recording unclaimed funds.
Furthermore, in accordance with paragraph 40-1 of the Rules for the Activities of the Central Depository, approved by Resolution No. 307 of the Management Board of the National Bank of the Republic of Kazakhstan dated November 29, 2018:
In the absence of current shareholder information in the company, the system of securities holders’ registries, and/or the nominee holding accounting system, the payment of dividends on the company’s common shares shall be made within five business days after the expiration of ninety calendar days from the day following the date of the general meeting of shareholders’ decision to pay dividends on common shares, to an account for unclaimed funds opened in the central depository’s accounting system;
In the absence of current shareholder information in the company, the system of securities holders’ registries, and/or the nominee holding accounting system, the payment of dividends on the company’s preferred shares shall be made within five business days after the expiration of ninety calendar days from the date of compilation of the list of shareholders entitled to receive dividends, to an account for unclaimed funds opened in the central depository’s accounting system.
