    Can a bank withhold more than 50% of a salary to repay a loan?

    Answer

    According to paragraph 2 of Article 36 of the Law of the Republic of Kazakhstan “On Banks and Banking Activities in the Republic of Kazakhstan,” debt collection from an individual borrower under a bank loan agreement through the submission of a payment demand is limited to fifty percent of the funds available in their bank account and/or of each amount subsequently credited to the borrower’s bank account. The collection is carried out without waiting for the full amount necessary to satisfy the payment demand to be available in the bank account.
