    Who can contact the Insurance Ombudsman to resolve disputes, and for which types of insurance?

    Answer

    According to paragraph 1 of Article 86of the Law of the Republic of Kazakhstan “On Insurance Activities”, an insurance ombudsman is a natural person who is independent in their activities and is responsible for resolving disputes:

    1. Between insurance organizations, arising from issues related to compulsory and voluntary insurance;

    2. Between policyholders (insured persons, beneficiaries) and insurance organizations, arising from insurance contracts.

    Individuals and/or small businesses acting as policyholders (insured persons, beneficiaries) have the right to apply to the insurance ombudsman for the resolution of disputes in all types of insurance.
    Other legal entities may apply to the insurance ombudsman only for disputes related to the compulsory civil liability insurance of vehicle owners.

    The amount of claims in disputes submitted by the persons mentioned in the second part of this paragraph must not exceed 10,000 times the monthly calculation index (MCI).
