    Can I file a lawsuit against an insurance company if I disagree with the amount of the insurance payout?

    Answer

    According to paragraph 5 of Article 90 of the Law of the Republic of Kazakhstan “On Insurance Activities,” the persons specified in the second part of paragraph 1 of Article 86 of this Law (individuals and/or small business entities) who are policyholders (insured persons or beneficiaries), as well as the insurer, have the right to file a lawsuit in accordance with the legislation of the Republic of Kazakhstan after receiving the decision of the Insurance Ombudsman. Therefore, you must first comply with the pre-trial dispute resolution procedure by contacting the Insurance Ombudsman. If you disagree with the Ombudsman’s decision, you then have the right to appeal to the court.
