On approval of the Regulations on the state institution "Department of Economics and Finance of the city of Ridder"

In accordance with paragraph 2 of Article 40 of the Administrative Procedural Procedure Code of the Republic of Kazakhstan, Article 124 of the Law of the Republic of Kazakhstan "On State Property", Resolution of the Government of the Republic of Kazakhstan dated September 1, 2021 No. 590 "On certain issues of organizing the activities of state bodies and their structural divisions", the Akimat of Ridder city DECIDES:

1. To approve the Regulation about the state institution "Department of Economics and Finance of the city of Ridder", according to the appendix to this resolution.
2. To cancel the resolution of the Akimat of Ridder city dated December 8, 2016 No. 1026 "On Approval of the Regulations on the state institution "Department of Economics and Finance of Ridder City".
3. The State Institution "Department of Economics and Finance of the City of Ridder" shall ensure the adoption of measures arising from this resolution provided for by the legislation of the Republic of Kazakhstan.
4. Control over the implementation of this resolution is entrusted to the supervising deputy akim of the city of Ridder.
5. This resolution shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Department of Economics and Finance of the City of Ridder

Chapter 1. General provisions

1. The state institution "Department of Economics and Finance of the City of Ridder" (hereinafter referred to as the state institution) is a state body of the Republic of Kazakhstan, performs, within its competence, functions in the field of strategic, economic, budgetary planning and execution of the city budget, accounting, budget accounting and budget reporting on the execution of the city budget, preparation of consolidated financial reporting, management of communal property in the city of Ridder.
2. A government agency has no departments.
3. A state institution carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as these Regulations.
4. A state institution is a legal entity in the organizational and legal form of a state institution, has a seal and stamps with its name in the state language, letterheads of the established sample, and accounts with treasury authorities in accordance with the legislation of the Republic of Kazakhstan.
5. A state institution enters into civil law relations on its own behalf.
6. A state institution has the right to act as a party to civil law relations on behalf of the State if it is authorized to do so in accordance with the legislation.
7. The state institution, in matters of its competence, in accordance with the procedure established by law, makes decisions drawn up by orders of the head of the Department and other acts provided for by the legislation of the Republic of Kazakhstan.
8. The structure and staffing limit of a public institution are approved in accordance with current legislation.
9. Location of the legal entity: 071300, Republic of Kazakhstan, East Kazakhstan region, Ridder city, K. Semenova Street, 19.
10. This Regulation is a constituent document of a state institution.
11. The financing of the activities of the state institution is carried out from the local budget of the city of Ridder.
12. A State institution is prohibited from entering into contractual relations with business entities for the performance of duties that are functions of the Department.

Chapter 2. Tasks, functions and powers of the state institution

13. Tasks of the state institution:

1) implementation of public administration in the field of strategic, economic and budgetary planning, implementation of priority areas of socio-economic development of the city, ensuring the execution of the city budget, effective management of urban communal property;

2) development of the main directions of socio-economic policy and monitoring of the socio-economic development of the city;

3) development of a draft city (local) budget for the upcoming fiscal year and for a three-year period based on economically sound income and expenditure planning in accordance with current legislation and organization of its execution;

4) budget accounting, preparation and presentation of consolidated financial statements on the state of debt;

5) management of municipal communal property.

14. Functions of a public institution:

1) formulates the main directions, goals and objectives of the region's development;

2) participates in the development of the forecast of socio-economic development and budget parameters of the East Kazakhstan region;

3) participates in the development and implementation of urban development programs within its competence;

4) organizes budget planning and coordinates the activities of budget program administrators;

5) reviews the passports of budget programs of budget program administrators, forms conclusions and submits them to the budget commission for consideration;

6) organizes the work of the budget commission;

7) develops a draft city budget for a three-year period and submits it to the city maslikhat for approval;

8) carries out an analysis of the approved, updated annual financing plan for all budgetary institutions of the city of Ridder for the fiscal year;

9) monitors the implementation of local investment projects;

10) organizes work on the execution of the city budget;

11) makes a cash flow forecast, which is the process of determining the expected amounts of budget receipts and expenditures for the planned period, the cash surplus (deficit) and sources of its coverage.;

12) draws up and approves a consolidated plan of financing for obligations, consolidated plans of receipts and financing for payments;

13) carries out registration of budget loans issued at the expense of budget funds, their accounting and monitoring;

14) carries out budget monitoring through regular and systematic collection, tracking and analysis of budget performance indicators;

15) monitors the progress of the development budget and investment projects;

16) carries out the analysis and assessment of communal property management;

17) coordinates the activities of administrators of budget programs for budget execution;

18) coordinates the consolidated plan of receipts and expenditures of money from the sale of goods (works, services) of the state institution remaining at its disposal, approved by the administrators of budget programs.;

19) manages budget money;

20) monitors the movement of money in the cash control account of the city budget;

21) ensures the maintenance of budget records and the preparation of reports on the execution of the city budget;

22) considers petitions for the allocation of funds from the reserve of the Akimat of the city in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

23) carries out an annual assessment of the effectiveness of the activities of executive bodies funded from the city budget for the management of budget money;

24) develops regulatory legal acts in the field of state property management within its competence;

25) manages municipal communal property within its competence;

26) exercise other powers stipulated by the legislation of the Republic of Kazakhstan.

15. Rights and powers of a public institution:

1) to submit proposals to the city administration on issues within the competence of the state institution.;

2) within the competence provided for by the legislation of the Republic of Kazakhstan to involve employees of other departments of local executive bodies of the city for consideration and joint development of issues related to the activities of the state institution;

3) initiate meetings in accordance with the established procedure on issues within the competence of the state institution;

4) request, within the competence established by the legislation of the Republic of Kazakhstan, from other state bodies, officials,

organizations and their managers, citizens, information necessary for the performance of their functions;

5) provide consultations on issues within the competence of a government agency;

6) provide the necessary materials and information within their competence and within the framework of legislation in the case of an official request from legal entities and individuals.;

7) perform other duties within the competence of a government agency.

Chapter 3. Status and powers of the head of the state institution "Department of Economics and Finance of the city of Ridder"

16. The management of a state institution is carried out by the first head, who is personally responsible for the fulfillment of the tasks assigned to the state institution and the exercise of its functions.
17. The first head of a state institution is appointed and dismissed by the Mayor of Ridder city in accordance with the legislation of the Republic of Kazakhstan.
18. Powers of the head of the state institution:

1) decides on the activities of a state institution in accordance with its competence, determined by the legislation of the Republic of Kazakhstan and these Regulations;

2) appoints and dismisses employees of a public institution in accordance with the procedure established by law.;

3) in accordance with the procedure established by law, carries out encouragement and imposes disciplinary penalties on employees of a public institution;

4) decides on the activities of a state institution in accordance with its competence, determined by the legislation of the Republic of Kazakhstan and these Regulations;

5) issues orders, gives instructions, and signs official documents within the limits of his competence.;

6) approves job descriptions of employees of a public institution;

7) represents the interests of a government agency in government agencies and other organizations;

8) approves the staffing table of the state institution within the limits of the staffing and structure approved by the resolution of the Akimat of the city of Ridder;

9) takes the necessary measures to combat corruption and bears personal responsibility for this.;

10) ensures equal access of men and women to public service in accordance with their experience, abilities and professional training;

11) exercise other powers in accordance with the legislation of the Republic of Kazakhstan.

The execution of the powers of the head of a state institution during his absence is carried out by the person replacing him in accordance with the current legislation of the Republic of Kazakhstan.

Chapter 4. Property of a state institution

19. A state institution may have separate property on the right of operational management in cases provided for by legislation.

The property of a state institution is formed at the expense of property transferred to it by the owner, as well as property acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

20. The property assigned to a state institution belongs to communal ownership.
21. A state institution shall not have the right to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds provided to it under the financing plan, unless otherwise established by law and these Regulations.

Chapter 5. Reorganization and abolition of a State institution

22. The reorganization and abolition of a state institution shall be carried out in accordance with the legislation of the Republic of Kazakhstan.
