Department of Control and Licensing of the Education Sphere

Main tasks, functions, rights and obligations of the Department

The main tasks of the Department are:

1) Participation in the formation and implementation of a unified state policy in the field of pre-school education and training, secondary, technical and vocational, post-secondary education, within the competence of the Department;

2) Participation in the implementation of state regulation in the field of education in order to ensure the quality of educational services provided by educational organizations of pre-school education and training, secondary, technical and vocational, post-secondary education by forming a system of state control implemented by territorial Departments for Quality Assurance in Education (hereinafter referred to as the Departments).

Functions:

1) Ensuring the timely and full execution of Decrees of the President of the Republic of Kazakhstan and Resolutions of the Government of the Republic of Kazakhstan, instructions of the leadership of the Ministry and the Committee, as well as the implementation of items of the annual action plan of the Ministry and the Committee within the competence of the Department;

2) Developing and submitting to the leadership of the Committee proposals on the formation of a unified state policy in the field of education, determining priority areas for the development of the education sector within the competence of the Department;

3) Coordination of the activities of the Departments in implementing state control over the implementation of the legislation of the Republic of Kazakhstan and regulatory legal acts in the field of education in pre-school education and training organizations, secondary, technical and vocational, post-secondary education regardless of the form of ownership and departmental subordination;

4) Coordination of the activities of the Departments in implementing state control over the implementation of the legislation of the Republic of Kazakhstan and regulatory legal acts in the field of education in education management bodies;

5) Coordination of the activities of the Departments in compliance with administrative procedural legislation when initiating administrative cases and bringing offenders to justice;

6) Coordination of the activities of the Departments in issuing mandatory written orders to eliminate identified violations of the legislation of the Republic of Kazakhstan in the field of education;

7) Participation in control activities to check the activities of educational organizations and education management bodies, implemented by territorial divisions of the Committee;

8) Development of criteria for assessing educational organizations;

9) Development of criteria for assessing the degree of risk and checklists for inspections of the education system;

10) Development of a semi-annual list of preventive control with visits to control entities based on the criteria for assessing the degree of risk;

11) Coordination and internal control of the activities of the Departments, as well as providing methodological assistance to them in the areas of activity of the Department;

12) Participation in the preparation of materials of the Board on the main areas of activity of the Department;

13) Submission of proposals when developing strategic documents within the competence of the Department;

14) Development and coordination of regulatory legal acts, within the competence of the Department, as well as organization of the activities of consultative and advisory bodies on issues within the competence of the Department;

15) Carrying out ongoing monitoring of by-laws developed and (or) implemented by the Department to identify those that contradict the legislation of the Republic of Kazakhstan, are outdated, corruptible and ineffectively implemented, to develop proposals for their improvement, as well as to take timely measures to amend and (or) supplement them or to recognize them as no longer in force;

16) Organizing and holding seminars, meetings and other events on issues within the competence of the Department;

17) Carrying out other functions stipulated by the laws of the Republic of Kazakhstan; acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

The Department has the right to:

1) Request and receive from other structural divisions of the Committee and territorial divisions documents and information necessary for the performance of the tasks and functions assigned to it by the Law and this Regulation;

2) Submit proposals to the management on improving the methods and mechanisms of state control;

3) Submit analytical reports and memos on issues related to the competence of the Directorate for consideration by the management of the Ministry and the Committee;

4) Represent the Committee in other government bodies and organizations within the competence of the Directorate;

5) Exercise other rights and obligations stipulated by the current legislation of the Republic of Kazakhstan.

6) The Directorate is not assigned additional tasks and functions that are not characteristic of its activities.
