Tasks, rights and duties of the Inspection
The task is to implement the state policy in the field of protection, reproduction and use of fish resources and other aquatic animals.
Duties of the Inspectorate:
1) to ensure the availability of public services;
2) to ensure that the recipients of public services are informed about the procedure for the provision of public services;
3) participate in the provision of relevant information to the authorized body for assessing the quality of public services and quality control of public services, the authorized body in the field of informatization to assess the quality of public services;
4) participate in the provision of relevant information to non-profit organizations conducting public monitoring, in accordance with the procedure established by law;
5) to consider complaints and appeals of recipients of public services, as well as individuals and legal entities;
6) comply with the legislation of the Republic of Kazakhstan, the rights and legally protected interests of individuals and legal entities;
7) timely and efficiently perform the Inspection functions assigned in accordance with this Regulation and the legislation of the Republic of Kazakhstan.
8) perform other duties provided for by the legislation of the Republic of Kazakhstan.
16. Inspection functions:
1) carries out intersectoral coordination of the activities of subjects in the field of fisheries;
2) implements state policy in the field of protection, reproduction and use of fish resources and other aquatic animals, as well as in the field of fisheries development;
3) exercises state control and supervision in the field of protection, reproduction and use of fish resources and other aquatic animals;
4) carries out international cooperation in the field of protection, reproduction and use of fish resources and other aquatic animals;
5) ensures the preparation of the budget application of the Inspection, its submission to the Committee, as well as the implementation of other procedures of the budget process;
6) participates in public procurement procedures in accordance with the legislation of the Republic of Kazakhstan in the field of public procurement;
7) considers cases of administrative offenses in the field of protection, reproduction and use of fish resources and other aquatic animals;
8) carries out and (or) organizes fishing for the purpose of introduction, reintroduction and hybridization, fishing for reproductive purposes, fishing in frozen reservoirs and (or) sites, as well as carries out control fishing;
9) issues permits for the production of introduction, reintroduction, hybridization of fish resources and other aquatic animals;
10) organizes and (or) ensures the conduct of scientific research and design and survey work in the field of protection, reproduction and use of fish resources and other aquatic animals;
11) organizes the maintenance of state accounting, cadastre and monitoring of fish resources and other aquatic animals;
12) organizes and ensures reproduction and state registration of wildlife in the reserve fund of fishery reservoirs and (or) sites;
13) on the basis of scientific recommendations, makes a decision on reclamation fishing in cases of a threat of overfishing, which will inevitably lead to the death of fish and the impossibility of eliminating such a threat by conducting ongoing fisheries reclamation of water bodies or their parts;
14) transfers the materials of inspections to law enforcement agencies for making a procedural decision;
15) determines the amount of damage caused as a result of violation of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fish resources and other aquatic animals, and on the basis of this, to make claims to the guilty persons for voluntary compensation for this damage or to file a lawsuit in court;
16) inspect water intake and discharge facilities for the presence of fish protection devices and their compliance with the established requirements;
17) exercises state control and supervision over compliance with the procedure for the introduction, reintroduction, and hybridization of fish resources and other aquatic animals;
18) checks the activity of users of the animal world in order to determine compliance with the requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fish resources and other aquatic animals;
19) checks the presence of full houses on fishery reservoirs and (or) sites, as well as their compliance with approved samples, as well as dates and places prohibited for fishing, logs of fishing of fish resources and other aquatic animals (fishing log);
20) carries out proceedings on cases of administrative offenses within the competence, in accordance with the legislation of the Republic of Kazakhstan;
21) provides information on the procedure for the provision of public services to a Single contact center for the provision of public services;
22) exercises state control and supervision over compliance with the rules of fisheries management;
23) carries out state control and supervision of compliance with the rules of fishing;
24) exercises state control and supervision over compliance with norms and regulations in the field of protection, reproduction and use of fish resources and other aquatic;
25) exercises state control and supervision over the implementation of measures for the protection, reproduction and use of fish resources and other aquatic animals;
26) exercises state control and supervision over compliance with the established restrictions and prohibitions on the use of fish resources and other aquatic animals;
27) exercises state control and supervision over local executive bodies in the field of protection, reproduction and use of fish resources and other aquatic animals;
28) monitors compliance with other requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fish resources and other aquatic animals;
29) coordinates, on the basis of a biological justification, the fishery reclamation on a fixed fishery reservoir and (or) site, the annual adjustment of the data of the fishing stock of fish resources and other aquatic animals carried out by users of the animal world with special use;
30) coordinates the feasibility study and design estimates developed by entities engaged in economic and other activities in the territories and reservoirs controlled by the Inspection (not related to reservoirs of international and national significance) specified in paragraphs 1 and 2 of Article 17 of the Law of the Republic of Kazakhstan "On Protection, Reproduction and Use of Wildlife";
31) coordinates the locations of enterprises, structures and other facilities, as well as the introduction of new equipment, technology, materials and substances that affect or may affect the state of fish resources and other aquatic animals;
32) coordinates the movement of all types of water transport with the engines turned on during the period prohibited for fishing in fishery reservoirs and (or) areas, as well as in places prohibited for fishing;
33) coordinates the installation of fish protection devices for water intake and discharge facilities;
34) issues a certificate of the origin of the catch;
35) holds a competition for the consolidation of fishery reservoirs and (or) sites of local significance;
36) enters into contracts for the management of fisheries;
37) carries out the re-consolidation of fishery reservoirs and (or) local areas;
38) decides to postpone the ban on the removal of wildlife objects for fifteen calendar days in one direction or another, depending on natural and climatic conditions, without changing the total duration of the ban on the recommendation of accredited scientific organizations in the field of protection, reproduction and use of wildlife;
39) upon detection of violations of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fish resources and other aquatic animals, suspends activities or makes a proposal to prohibit the activities of users of the animal world in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
40) performs other functions provided for by the legislation of the Republic of Kazakhstan, acts of the President, the Government of the Republic of Kazakhstan, the Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan and the Chairman of the Fisheries Committee of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan, as well as this Regulation.
