"Department of passenger transport and highways of the city of Tekeli"

1. General provisions

1. the state institution "Department of passenger transport and highways of the city of Tekeli" (hereinafter - the Department) is a state body of the Republic of Kazakhstan that provides guidance in the field of passenger transport and highways.

2. the Department carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as these Regulations.

3. the Department is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the Treasury bodies.

4. The Department enters in civil-legal relations from own name.

5. the Department has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the law.

6. The Department on questions of its competence in accordance with legislation makes decisions orders of the head of Department and other acts, stipulated by the legislation of the Republic of Kazakhstan.

7. The structure and staff limit of the Department are approved in accordance with current legislation.

8. Location of the legal entity: index 041700, Republic of Kazakhstan, Almaty region, city of Tekeli, Abylai Khan street, no. 34.

9. Full name of the state body – state institution "Department of passenger transport and highways of the city of Tekeli".

10. This Regulation is the founding document of the Department.

11. Financing of the Department activity is realized from local budget.

12. the Department is prohibited from entering into contractual relations with business entities for the performance of duties that are the functions of the Department.

If the Department is granted the right to carry out income-generating activities by legislative acts, the income received from such activities is directed to the state budget revenue.

2. Mission, main tasks, functions, rights and responsibilities of the Department

13. mission of the Department: implementation of public administration functions in the field of passenger transport and highways in the territory of the city of Tekeli.

14. Tasks:

within its competence, the organization of state management of highways;
organization of construction, operation and development of highways.

15. Functions:

organization of works on construction, reconstruction, repair and maintenance of public roads of urban significance and streets in accordance with the legislation of the Republic of Kazakhstan;
managing the network of urban public roads and streets;
issuance of a permit for placement of outdoor (visual) advertising on objects of stationary advertising placement in the right-of-way of public roads of regional and district significance;
consideration of requests from individuals and (or) legal entities and (or) its branches and representative offices on advertising issues;
organization of regular urban, suburban and intercity passenger and baggage transportation, approval of their routes, organization and holding of competitions for the right to service them, and approval of timetables for routes;
maintaining a register of routes for regular urban, suburban, and intercity automobile transport of passengers and Luggage;
implementation of other functions provided for by the legislation of the Republic of Kazakhstan.

16. Rights and obligations:

1) request and receive information necessary for their activities from state bodies and other organizations;

2) exercise the use of property that is under the right of operational management;

3) develop drafts of normative legal acts of the mayor's office, the city's mayor's office within the competence of the Department;

4) timely and high-quality consideration of requests from individuals and legal entities;

5) exercise other rights and obligations within its competence in accordance with the legislation of the Republic of Kazakhstan.

3. Organization of activities of the Department

17. The leadership of the Department is the first leader who is personally responsible for implementation of Division of tasks and the exercise of its functions.

18. the First head of the Department is appointed and dismissed by the mayor of the city of Tekeli.

19. the First head of the Department has no deputies.

20. Authority of the first head of the Department:

1) determine the duties and powers of the Department's employees within its competence;

2) appoint and dismiss employees of the Department in accordance with the current legislation;

3) in accordance with the procedure established by law, encourages and imposes disciplinary penalties on employees of the Department;

4) issue orders within its competence;

5) within its competence, represents the interests of the Department in judicial, state bodies and other organizations;

6) counteracts corruption in the Department with the establishment of personal responsibility for it;

7) exercise other powers in accordance with the legislation of the Republic of Kazakhstan.

The powers of the first head of the Department during his absence are performed by the person who replaces him in accordance with the current legislation.

4. Property Of The Department

21. the Department may have separate property on the right of operational management in cases stipulated by law.

The property of the Department is formed at the expense of the property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

22. The property assigned to the Department, which belongs to municipal property.

23. the Department is not entitled to independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.

5. Reorganization and abolition of the Department

24. the Department is Reorganized and abolished in accordance with the legislation of the Republic of Kazakhstan.
