On the basis of the order of the head of "Department of veterinary science of the akimat of Kostanay region" (hereinafter-the Administration) No. 63 on 23 June 2020, "an internal analysis of corruption risks" on June 26, 2020 was an internal analysis of corruption risks in the activities of the state municipal enterprise "Veterinary station of Uzynkol district" of the veterinary Department of akimat of the Kostanay region" (hereinafter - the Company) for the period 01 January 2020 to present the following members of the working group:

The subject of the Company's activities is the implementation of activities in the field of veterinary medicine.
The purpose of the Enterprise is to conduct veterinary activities on the territory of the Uzunkolsky district.
To achieve this goal, the Company carries out the following activities::
1) carrying out veterinary measures against particularly dangerous, non-infectious and enzootic animal diseases;
2) identification of farm animals;
3) provision of services for artificial insemination of farm animals;
4) provision of services for the transportation( delivery), storage of veterinary drugs against particularly dangerous and enzootic animal diseases, as well as transportation (delivery) of products (means) and attributes for the identification of farm animals;
5) maintenance of animal burial grounds( biothermal pits), slaughterhouses (sites for slaughtering farm animals), the construction of which is organized by the local executive bodies of the relevant administrative-territorial units;
6) capture and destruction of stray dogs and cats;
7) issue of a veterinary certificate;
8) maintaining a database on the identification of farm animals and issuing an extract from it;
9) sampling of biological material and their delivery to the veterinary laboratory;
10) provision of services for the transportation of sick animals for sanitary slaughter.
According to the order of the head of the Department dated February 27, 2020 No. 8, the acting head of the Enterprise is D. B. Karimov.
"Identification of corruption risks in regulatory legal acts and legal acts affecting the activities of the Enterprise".
The company in its activities is guided by the following normative legal acts, the Constitution, Labor Code, Law "On veterinary medicine", the Law "On public procurement", the Law "On civil service in the Republic of Kazakhstan", the Law "On combating corruption", the Law "About an order of consideration of appeals of individuals and legal entities", the Charter of the Enterprise approved by the resolution of the akimat of Of the Kostanay region dated February 3, 2020 No. 45, and other laws and regulations regulating the activities of the Enterprise.
In the direction of "Identification of corruption risks in regulatory legal acts and legal acts affecting the activities of the Enterprise", no corruption risks were identified.
The analysis of the succession of frames.
The Company employs 32 people, including 16 veterinary workers, 16 auxiliary and technical personnel.
For 2020, 6 employees were hired, 6 employees were dismissed, all at their own request. There are 10 vacancies, including 4 vacancies for the position of a veterinarian, 6 vacancies for auxiliary positions.
Appeals of individuals and legal entities.
The analysis of incoming letters found that from January 01, 2020 to June 25, 2020, the Company received 22 appeals from individuals and legal entities, all of which were answered.
Provision of public services
In accordance with the order of the Acting Minister of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan dated January 31, 2020 No. 39 / NC "On Approval of the Register of Public Services" in the field of veterinary medicine, the Company provides two public services:
The results of a veterinary certificate;
Issue of a veterinary passport.
So, as of June 26, 2020, the Enterprise provided 958 state services "Issuing a veterinary certificate", 1203 state services "Conducting identification of farm animals, with the issuance of a veterinary passport", while there is a fact of non-improvement and lack of integration of the EACU database with the e-Government portal. This does not allow citizens to receive these services in electronic format. These circumstances lead to direct contact between the service recipient and the service provider, which subsequently creates conditions for corruption.
In addition, the lack of strict accounting of forms of veterinary certificates allows anyone to order forms in a printing house and can lead to their falsification, but the legislation does not provide for rules that oblige to keep records of issued certificates, that is, to trace their legality through information systems.
Public procurement
The Department conducts public procurement in accordance with the provisions of the Law of the Republic of Kazakhstan dated December 4, 2015 "On Public Procurement", Order of the Minister of Finance of the Republic of Kazakhstan dated December 11, 2015 No. 648 "On Approval of the Rules for Public Procurement". Public procurement of goods, works, and services is carried out through the web portal of public procurement in electronic form, and excludes any contact with the supplier. The exclusively electronic format for concluding contracts allowed us to generate complete and reliable information on the purchased goods, works, and services on the web portal and determine their average purchase prices.
The introduction of electronic contracts and a number of other regulations aimed at simplifying and transparency of public procurement minimize corruption risks.
As of 26 June, the Company as a customer was concluded the contract on the state purchases, totaling more than 5 486 152 (five million four hundred eighty-six thousand one hundred fifty-two tenge), it was found that all agreements concluded by method from one source through direct imprisonment.
At the same time, in violation of the Law of the Republic of Kazakhstan "On Public Procurement", contracts for the purchase of fuel and lubricants in the total amount of 995,000 tenge were unreasonably concluded,
Also, in violation of subparagraph 1 of Article 4 of the Law of the Republic of Kazakhstan "On Public Procurement", in order to optimize and effectively spend the money used for public procurement, the Company does not have a complete set of documents (price offers) justifying the conclusion of a contract with suppliers from one source by direct conclusion.
The analysis of the concluded contracts for 2020 showed that the Company has facts of approval of the act of acceptance and transfer of goods through the web portal without the mandatory attachment of an electronic copy of the invoice by the supplier or the absence of the customer's signature in the invoice confirming the fact of delivery of the goods (Paragraph 426 of the Rules for Public Procurement). For example, a contract for the purchase of medicines LLP "Willow R." on the amount 32100 tenge, purchase veterinary forms with "printing Kostanay" in the amount of KZT 72200, the acquisition of the office UI Golubitskaya L. B. in the amount of 150,000 tenge.
In addition, it was established that on March 20, 2020, the Company concluded a contract with the Sole Proprietor "Carrier" for the supply of firewood with a delivery period of no more than 15 calendar days, while the goods have not been delivered to date, thereby the delivery period was violated, and no actions on the part of the Company were taken on this fact.
Thus, the above facts contribute to the creation of conditions for corruption risks in the Enterprise, including the provision of preference to a specific supplier when conducting public procurement.
Conflict of interest resolution
No conflict of interest has been identified in the Company's activities.
Based on the results of the internal analysis of corruption risks, the working group made the following recommendations:
To the Head of the Enterprise:
- in order to eliminate the identified violations by July 31, 2020, to resolve the issue of collecting the penalty under the contract of March 20, 2020 with the sole Proprietor "Carrier".
- when conducting public procurement procedures, in strict compliance with the legislation of Kazakhstan, to avoid allegations of act of reception-transmission of goods through the web portal without necessarily attaching a provider of an electronic copy of the invoice or the lack of the signature of the customer on the invoice confirming the delivery, avoid the non-compliance of mandatory requirements for the delivery of goods, works and services, as well as conducting public procurement to ensure the principle of optimal and efficient spending of money, with documentary confirmation (availability of price offers from suppliers of at least 2);
- when conducting personnel records management, strictly observe the requirements for personnel records management;
- not to allow early removal of disciplinary penalties for the purpose of subsequent bonuses to employees.
