State Legal Department

Functions:

1) represents, in accordance with the established procedure, the interests of the state body in court, as well as in other organizations when considering legal issues of the activities of the state body;

2) coordinates on an ongoing basis the monitoring of regulatory legal acts in the manner determined by the Government of the Republic of Kazakhstan;

3) participates in the development of drafts of legal and regulatory legal acts, contracts, procedural documents, as well as other legal documents developed by the state body, including through coordination in the case of their development by other structural units of the state body;

4) develops drafts of regulatory legal acts and prepares other legal documents on behalf of the first head of the state body;

5) develops and implements annual events to promote the legislation of the Republic of Kazakhstan, the organization of legal education in the state body;

6) prepares, in cases provided for by legislative acts, explanations on behalf of the state body on legal issues related to the competence of the state body;

7) analyzes the normative activity of the akim, akimat of the region and, based on the results of the analysis, makes proposals to the akim of the region for its improvement and elimination of the identified shortcomings and twice a year, before the 10th of the next month of the half-year, send information to the Ministry of Justice about the analysis and measures taken;

8) ensures compliance of contracts with the requirements of legislation, the application of measures provided for by law in case of non-fulfillment and improper fulfillment of obligations under contracts;

9) analyzes the status of the claim work, judicial practice on disputes involving the akim, akimat of the region and the Apparatus in order to identify the main causes and conditions that led to the relevant trial and makes proposals for their elimination and bringing to justice the guilty officials;

10) if there are grounds provided for by law, promptly takes measures to appeal a judicial act adopted not in favor of a state body in all judicial instances, and also, in accordance with the procedure established by law, applies to the prosecutor's office with petitions for bringing protests in the order of supervision;

11) ensures the adoption of measures for the execution of judicial acts that have entered into legal force;

12) carries out visits to the districts of the region to get acquainted with local activities, collect information in order to develop and organize effective operational measures for the functioning of regulatory legal acts of the akim and akimat of the region;

13) interacts with other state bodies within the established tasks and functions;

14) performs other assignments of the akim of the region, his deputies and the head of the akim's office of the region.
