Department of subsoil use

Main functions of the Department:

1) coordinates the activities of Central and local Executive bodies for the implementation of state policy in regulated areas;

2) participation in the development of program documents within its competence;

3) develops the regulations of the expert Commission on subsoil use issues, the composition of the expert Commission on subsoil use issues;

4) develop rules of organization and holding of auctions, including qualifying requirements to the bidders, the contents and order of filing of the application, the financial security of applications for participation in the auction and the terms of payment and the return order totals and determine the winners, securing their approval and registration;

5) develop forms and Rules for submitting reports during the exploration and production of hydrocarbons, uranium, and experimental production and production of uranium, ensure their approval and registration;

6) develops regulations on the working group for direct negotiations with the national company in the field of hydrocarbons and uranium, ensures their approval and registration;

7) develops standard contracts for subsurface use, ensures their approval and registration;

8) submit an annual report to the Government of the Republic of Kazakhstan on the implementation of the terms of concluded subsoil use contracts;

9) organize and conduct an auction for the granting of subsoil use rights for hydrocarbons by the Commission for conducting auctions for the granting of subsoil use rights for hydrocarbons;

10) executes normative legal acts, strategic and program documents, achievement of goals and objectives in regulated areas;

11) organize an independent review of basic project documents and development analyses;

12) state registration and storage of subsurface use contracts for hydrocarbons and uranium production;

13) ensuring compliance with the interests of the Republic of Kazakhstan in contracts for exploration and production and for the production of hydrocarbons and uranium in accordance with the powers established by the legislation of the Republic of Kazakhstan;

14) develop and approve the list of strategic subsurface areas;

15) coordinates the strategic partner identified by the national company for joint implementation of projects under contracts concluded as a result of direct negotiations between the national company and the competent authority or in accordance with international agreements ratified by the Republic of Kazakhstan;

16) approves the draft contract for subsurface use developed by the winner of the competition or the person with whom the contract is concluded on the basis of direct negotiations;

17) monitors compliance of subsoil users with their obligations under the subsoil use contract;

18) performing other functions within the scope of this task assigned in accordance with the procedure established by law.

19) carry out, within its competence, consideration of appeals from individuals and legal entities;

20) prepare materials for the meeting of the expert Commission on subsoil use of the Ministry;

21) develop rules for the acquisition by subsoil users and their contractors of goods, works and services used in the conduct of operations for the exploration or production of hydrocarbons and uranium, ensure their approval and registration;

22) coordinate the procedure for conducting economic expertise of draft subsoil use contracts;

23) develops the composition of the Commission for conducting auctions for granting subsoil use rights for hydrocarbons, ensures their approval and registration;

24) develops methods for calculating the contractual obligations of subsoil users for training citizens of the Republic of Kazakhstan, ensures their approval and registration;

25) determines the procedure for financing the training of Kazakhstani personnel in the amount of one percent of the production costs incurred by the subsoil user in the previous year, together with the authorized body in the field of education;

26) performs trust management of the shares of the company defined by the Government of the Republic of Kazakhstan as the authorized body in the production sharing agreements;

27) provides protection and representation of the interests of the Republic of Kazakhstan in international arbitration and foreign courts, as well as in expert settlement of disputes arising from production sharing agreements;

28) develop a list of priority works and services, ensure their approval and registration;

29) grants and terminates, prematurely terminates, subsurface use rights for exploration and production of hydrocarbons and uranium production;

30) enter into a contract for the exploration and production or production of hydrocarbons and for the production of uranium;

31) approves programs for managing the state subsoil Fund;

32) enter into a trust management agreement with the national company for the contract territory, in case of early termination of the contract for hydrocarbons and uranium;

33) defines the procedure for monitoring compliance of subsoil users with their obligations under the contract (license) for subsoil use;

34) develop rules for maintaining the register of concluded subsurface use contracts, ensure their approval and registration;

35) develops rules for conducting an auction in electronic form using the Internet resource of the authorized body in the field of hydrocarbons, ensures their approval and registration;

36) develop rules for financing research, scientific and technical and (or) development work by subsurface users during the period of hydrocarbon production and uranium production together with the authorized body in the field of science, ensure their approval and registration;

37) develops rules for synchronizing the work of electronic procurement systems with the work of the register of goods, works and services used in conducting subsurface use operations in relation to hydrocarbons and uranium production, and their producers, ensures their approval and registration;

38) develops forms and rules for submitting annual (for one financial year) and medium-term (for five financial years) procurement programs for goods, works and services to the authorized body in the field of hydrocarbons and uranium production, ensures their approval and registration;

39) defines the operator in the field of support of Kazakhstan's personnel and producers in relation to hydrocarbons and uranium production;

40) develop rules for the formation and maintenance of a register of goods, works and services used in the conduct of subsurface use operations for hydrocarbons and uranium production, and their producers, including the criteria for their assessment for inclusion in the register, ensure their approval and registration;

41) develops regulations on the working group for negotiations on amendments and additions to the subsoil use contract, ensures their approval and registration;

42) develops the contents of the working program forms, ensures their approval and registration;

43) within its competence, together with the Department of budget and financial procedures, monitors the execution of public procurement contracts;

44) conducts legal monitoring of regulatory legal acts (including those previously adopted by the Department) and takes timely measures to make changes and (or) additions to them or to recognize them as invalid.
