Department of legal services

Department of legal services:

- represents the interests of the Ministry of trade and integration of the Republic of Kazakhstan in court, as well as in other organizations when considering legal issues of the Ministry of trade and integration of the Republic of Kazakhstan;

- coordinates on an ongoing basis the monitoring of regulatory legal acts of the Republic of Kazakhstan in the manner determined by the Government of the Republic of Kazakhstan;

- participates in the development of draft legal and regulatory legal acts, agreements, procedural documents, as well as other legal documents developed by the Ministry of trade and integration of the Republic of Kazakhstan, including through approval, if they are developed by other structural divisions of the Ministry of trade and integration of the Republic of Kazakhstan;

-necessarily involved in passing bills in the Parliament of the Republic of Kazakhstan, as well as at completion in working order of the draft conclusions of the Government on the draft laws initiated by parliamentary deputies, or deputies of the amendments made to the bill, initiated by the Government in the Office of the Prime Minister, projects of decrees of the President, Government resolutions and orders of the Prime Minister of the Republic of Kazakhstan, developed by the Ministry of trade and integration of the Republic of Kazakhstan, the Prime Minister's Office and Ministry of justice;

- participates in each meeting of the Interdepartmental Commission on issues of legislative activity;

- develops draft regulatory legal acts and prepares other legal documents on behalf of the Minister of trade and integration of the Republic of Kazakhstan;

- develops and implements annual events to promote the legislation of the Republic of Kazakhstan, organization of legal education in the Ministry of trade and integration of the Republic of Kazakhstan;

- prepares explanations on behalf of the Ministry of trade and integration of the Republic of Kazakhstan on legal issues within the competence of the Ministry of trade and integration of the Republic of Kazakhstan in cases stipulated by legislative acts;

- organize systematic accounting and storage of regulatory legal acts of the Republic of Kazakhstan received by the Ministry of trade and integration of the Republic of Kazakhstan;

-analyzes on an ongoing basis norm-setting activities of the Ministry of trade and integration of the Republic of Kazakhstan remarks of the Ministry of justice on the results of legal examination of projects of regulatory legal acts and regulatory legal acts provided for in subparagraphs 6), 7), 8), 9) paragraph 2 of article 7 of the Law of the Republic of Kazakhstan "On legal acts" subject to state registration with the justice authorities, and the results of the analysis contribute to the Minister of trade and integration of the Republic of Kazakhstan, as well as the Executive Secretary of the Ministry of trade and integration of the Republic of Kazakhstan proposals for its improvement and elimination of identified shortcomings and twice a year before the 10th day of the next month half year sends information to the Ministry of justice on the analysis and measures taken;

- ensures compliance of contracts with legal requirements, application of economic measures of influence in case of non-performance and improper performance of obligations under contracts;

- analyzes the state of the claim work, judicial practice in disputes involving the Ministry of trade and integration of the Republic of Kazakhstan in order to identify the main causes and conditions that led to the relevant court proceedings and make proposals for their elimination and bringing to justice the guilty officials;

-in case of existence of grounds provided by the legislation, take timely action to appeal the judicial act not in favor of the Ministry of trade and integration of the Republic of Kazakhstan in courts of all instances and in the manner prescribed by law refers to the Prosecutor's office with petitions bearing the protests in the order of supervision;

-ensures the adoption of measures on execution of an enforceable judicial acts.
