Baikonyr Department of State Property and Privatization of the Committee for State Property and Privatization of the Ministry of Finance of the Republic of Kazakhstan

Functions of the Department:

1) coordination of the transfer of property assigned to republican legal entities, with the exception of the transfer of property of republican state institutions, which are central state bodies, and state enterprises;

2) approval of dividing, intermediate liquidation and liquidation balances, as well as deed of transfer during the reorganization and liquidation of territorial divisions of central executive bodies;

3) provision of republican property, in property lease (lease), trust management to individuals and non-state legal entities without the right of subsequent redemption, with the right of subsequent redemption or the right of subsequent transfer to the ownership of small businesses on a gratuitous basis, with the exception of making a decision to transfer to trust management of property assigned to republican state enterprises;

4) if there is a state material reserve at the privatization object, a notification to the authorized body in the field of the state material reserve and the relevant central executive bodies within five working days after the decision to sell, for him to make a decision on the further placement of these material assets before the privatization of the object ;

5) the implementation of the privatization of republican property, as well as enterprises as a property complex that are not subjects of natural monopoly or market entities occupying a dominant or monopoly position in the market, ensuring the safety of republican property in the process of preparing an object for privatization, engaging an intermediary to organize the privatization process, ensuring appraisal of the privatization object, preparation and conclusion of sale and purchase agreements for the privatization object and control over compliance with the terms of the sale and purchase agreements;

6) preparation and submission, at the buyer's request, of information on the encumbrances of privatization objects, as well as the amount of accounts payable and receivable, contracts concluded by the privatized enterprise, if the object of privatization is an enterprise as a property complex;

7) representing the interests of the state on issues of republican property, protecting property rights belonging to the Republic of Kazakhstan;

8) participation in the implementation of state monitoring of property in sectors of the economy of strategic importance, in accordance with the Law of the Republic of Kazakhstan dated November 4, 2003 "On state monitoring of property in sectors of the economy of strategic importance";

9) participation in tracking the objects of monitoring according to the main production, technical, technological, financial, economic, legal and other parameters in order to analyze the ongoing changes and forecast the development of productive forces in sectors of the economy that are of strategic importance;

10) collection of income from the lease of property in republican ownership to the republican budget;

11) participation in the acceptance of facilities created on the basis of concession agreements and public-private partnership into republican ownership;

12) exercising, at least once every three years, control over the intended use of state property and the seizure of excess, unused or misused property in relation to republican property;

13) conclusion of donation agreements, signing and approval of acts of acceptance and transfer of property of non-state legal entities and individuals;

14) keeping records of property, the rights to which were acquired by the state under a donation agreement, by entering information about it in the register of state property;

15) implementation, in agreement with the authorized body of the relevant industry, of the seizure or redistribution of property transferred to the territorial state body and institution;
